BREAKING NEWS – Changes to unfair dismissal rules in Jersey

In their December newsletter HR Now provided an overview of the new rules.

Any employee who started with their employer before 1 January 2015 will retain the right not to be unfairly dismissed after 26 weeks' continuous service.

For the avoidance of doubt, the right not to be unfairly dismissed also includes the concept of constructive unfair dismissal.

It is important to note that the employee must actually start the employment itself on or after 1 January 2015 to fall into the new 52 week bracket. It doesn't matter when the contract was agreed and signed (which could be late December), the important date is that upon which employment actually starts.

Employers should note that the new qualifying period does not affect an Employee's right to claim for any of the 'automatic unfair dismissals' which require no specific length of service. This change also does not affect fixed term contracts where the current 2/3rds or 13 weeks qualifying period still applies.
