When we think about future planning, most of us prioritise things like pensions, insurance, or writing a Will. But one of the most vital documents you can put in place is often overlooked:  Lasting Powers of Attorney (LPA).

LPAs allow people you trust to step in (rather than the Court) and make decisions on your behalf if you are temporarily or permanently unable to do so. That could be due to illness, accident, or a decline in mental capacity. What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document that gives someone you trust the authority to make decisions if you cannot. There are two types:

  • Property & Financial Affairs LPA – Covers decisions about your money, bank accounts, home, and bills.
  • Health & Welfare LPA – Covers decisions about care, treatment, and where you live.

I am shocked when some adviser say you only need one or the other type.  Imagine needing care, and the cash poor Council save money by sending you to a lovely care facility in Rwanda.  If you only have the Finance LPA, you can pay the bills, but not insist that they stay local – as that is the right of the Health and welfare attorney.  Crucially, they must be set up in advance while you still have capacity and the labyrinthine administrative process typically takes THREE MONTHS.


Why acting early matters

Many people assume LPAs are something to sort out in later life—but that thinking can backfire. Capacity can be lost at any age due to injury, stroke, or sudden illness. Once that happens, it is too late to make an LPA. Instead, your family may have to apply to the Court of Protection, which is time-consuming, expensive, and emotionally draining.

By putting LPAS in place now, you stay in control. You choose who speaks for you. You protect your family from stress at an already difficult time.
