On 8 October 2026, East Sussex Fire & Rescue Service announced a successful prosecution relating to premises forming part of Queens Arcade in Hastings.
The case involved a failure to provide information and documentation requested by an authorised fire safety inspector under the Regulatory Reform (Fire Safety) Order 2005.
On 6 October 2026, Brighton and Hove Magistrates' Court found the parties involved guilty of offences relating to their failure to comply with the inspector's lawful requests.
Although the prosecution concerned a failure to provide information, rather than a failure to undertake a fire risk assessment, it serves as a reminder that fire safety responsibilities must be taken seriously.

Under the Regulatory Reform (Fire Safety) Order 2005, most commercial premises are required to have a suitable and sufficient fire risk assessment.
This applies to businesses of all sizes, from small independent shops and offices to restaurants, gyms, salons and larger commercial premises.
A fire risk assessment considers potential fire hazards, escape arrangements, fire detection, emergency lighting, fire doors and how fire safety is managed.
Importantly, fire safety doesn't need to be complicated or unnecessarily expensive.
The precautions required should reflect the size, layout and use of the premises, as well as the people who may be at risk.
At Southern FRA, we understand that running a business comes with plenty of responsibilities, which is why we aim to make fire safety straightforward.
Our assessments provide detailed reports, supporting photographs and clear action plans if required, outlining our findings and any recommended improvements to help businesses understand and manage their fire safety responsibilities.
We're not here to upsell products, recommend unnecessary work or create additional expense. We're here to help ensure fire safety for everyone.
If existing precautions are suitable, we'll say so. If improvements are necessary, we'll explain why and recommend a sensible, proportionate approach.
Alongside fire risk assessments, we also provide fire door inspections, evacuation plans and fire safety strategies.
As a way of supporting our local business community, we're offering 10% off fire risk assessments for Eastbourne businesses until 31 December 2026.
Whether you're opening new premises, reviewing your existing fire safety arrangements or simply want reassurance that your business is meeting its responsibilities, we're happy to help.
