A recent article, picking up on the recent changes to paternity leave and taking into account the introduction of the Equality Act, has looked at  it the many issues around flexible working and the right of an employee to request flexible working arrangements. In particular:

  • Can you refuse a request?
  • What are the statutory procedures?

If an employer should fail to follow the correct procedure the employee may have a case to take them to an employment tribunal.  A successful claim by the employee may then result in the award of compensation from the employer and the need to reconsider the application.
