Plan of action:
Our plan of action is to, over a period of time, contest the validity of the personal guarantee with the bank or at the very least get it negotiated into a position that allows you to repay a smaller amount than is due over a suitable period of time.
We start by requesting copies of original documents and if they can't even produce these, which is often the case, then their position is very much prejudiced, especially if there is no charge in place, this will be a significant issue for them.
We draft carefully worded letters at each stage for you to agree and send. We continually let them know that we will get back to them in a certain period of time and you should avoid telephone and email contact of any sort. If they do phone, ask them to respond in writing.
