Buyers and sellers can help reduce chance of home-sale collapse, says Addison O’Hare

When a sale or purchase falls through both the buyer’s and seller’s time and money can be wasted. Addison O’Hare in Walsall, which is an accredited member of the national Law Society’s Conveyancing Quality Scheme (CQS), says that buyers and sellers can help themselves to reduce the chances of a sale falling through.

Dix Wilton, a Partner and Head of the Conveyancing Team says: ”Sellers in particular can act early to prevent delays later on in the sale. This can be a major contributing factor towards a sale falling through. It pays to get a CQS solicitor involved as early as possible, even before a buyer has been found. They will then be able to look at the title to make sure that everything is up-to-date and help the sellers make sure that all their paperwork is in order, particularly planning permissions and building regulation consents.

“Sellers sometimes think that if everything is not in order the buyers will be prepared to go ahead anyway but often forget that the buyer’s mortgage lender will require all the boxes to be ticked. This may include making sure that all the Competent Person Certificates, for example, of the installation of windows or a boiler, are available.

If your transaction is part of a chain, missing documentation for one can mean disappointment for many other people, not just the next person in the chain. Involving a CQS solicitor early may help to guard against that.”
