And remember - your initial consultation is always free, and after this, there are several ways of funding your claim. The team at MartinKaye Injury LLP will discuss all the options with you, including "no-win no-fee" agreements if appropriate. In this instance, if your claim is not successful, you would not be expected to fund your legal costs although if you do not take out insurance you would be responsible for the disbursements (things like the cost of obtaining your medical records and medical report).
A successful claim would usually see legal costs claimed from the opponents in addition to your compensation. As a result of recent changes to the law successful Claimants are now liable to pay, out of their compensation, the success fee and cost of the insurance premium (if taken out). This is however capped at 25% of general damages and past losses and so you will always receive at least 75% of your compensation if you are successful in your claim. Insurance can be taken out to avoid having to pay for the disbursements if the case is unsuccessful.
