Liquidation
Liquidation can apply to both partnerships and companies, and involves the winding up of the business through the distribution of assets, usually followed by the closing of the business.
There are three types of Liquidation:
Individual Voluntary Arrangement
An IVA is a financial recovery plan for individuals, which ring-fences both personal and trading liabilities (if applicable) in an arrangement with Creditors.
This arrangement protects the individual and offers a better return to Creditors than bankruptcy as the individual's liabilities and interest are frozen and satisfied, either in part or full, over the course of months or years.
Administration
Administration is a rescue procedure using a court order to restructure the limited company in financial trouble, perhaps as a going concern and certainly with the aim of achieving a more satisfactory outcome than Liquidation.
Company Voluntary Arrangement
A CVA is a rescue plan that ring-fences the company's liabilities (usually in excess of £50,000) into an arrangement with Creditors. This arrangement both protects the company and offers a better return to Creditors than Liquidation. Liabilities and interest are frozen and satisfied in part or in full over what can be a long period of time.
