Why do we place so much emphasis on LPAs?

Because when someone dies without having a Will, most families will deal with and overcome the effects of the intestacy relatively quickly. In comparison, the stress and financial impact that descends upon a family hit by incapacity will be far harsher, much more intrusive and can continue for many, many years.

Once the financial institutions, including banks, are aware of the situation they will follow the rules of the Incapacity Act and will freeze the accounts (including joint accounts) held in the name of the incapacitated individual. No access will be given to any family member, not even the spouse, until they can present valid Court authority of access. Without a LPA this means a long and very expensive form filling application to the Court of Protection. The application has no guarantee of success and the Court could appoint an absolute stranger to take over all aspects of the individuals finances!

It's not all about financial matters either. The LPA (personal welfare) can help remove much of the frustration for families regarding medical decisions and health matters for the incapacitated person.
