Who owns the Company Twitter account?

Social media is becoming a large part of a business’s day to day activities.

It is now embedded in marketing strategies, even in job descriptions, as more employers entrust their employees to handle company Twitter and Facebook accounts.

So what happens however when an employee leaves their post?  Joy Arkley of the HR Dept West Wales discusses how ownership can get blurred.......

So who gets ‘custody’ of the twitter account?

Naturally, the simple answer would be the company. However, without a social media policy in place - where each party stands becomes blurred.

Noah Kravitz accumulated 17,000 followers on his @PhoneDog_Noah account while working for PhoneDog. After refusing to surrender the account back to the company, PhoneDog sued on the grounds of trade secret misuse amongst others.

The lesson learnt in this case is that there needs to be a clause in the contract that stipulates ownership of accounts.
